Mobile Terms & Conditions

Room & Board, Inc. (“Room & Board”) offers a mobile messaging service (the “Messaging Service”) to provide (1) order and delivery updates and (2) marketing messages. By opting in (as noted below) and participating in the Messaging Service you accept and agree to these Mobile Terms & Conditions, the Terms of Use and Privacy Policy, including, without limitation, your agreement to resolve any disputes with Room & Board through binding, individual-only arbitration, as detailed more fully in the Terms of Use.
These Mobile Terms & Conditions are limited to the Messaging Service and are not intended to modify the Terms of Use or Privacy Policy that may govern the relationship between you and Room & Board in other contexts. To the extent there is any conflict between these Mobile Terms & Conditions and the Terms of Use, the Terms of Use shall prevail.
We reserve the right to change these Mobile Terms & Conditions from time to time at our sole discretion. Please review the “Last Updated” date at the end of these Mobile Terms & Conditions which provides the date these Mobile Terms & Conditions were last changed. Any use of the Messaging Service following the date on which changes to these Mobile Terms & Conditions are published on this website shall constitute your acceptance of all such changes. You expressly agree that Room & Board shall have no obligation to provide you with any notice of any changes, other than publishing the “Last Updated” date, and to the fullest extent permitted by applicable law, you hereby expressly waive any right you may have to receive any other notice of any changes to these Mobile Terms & Conditions.
How to Opt In
Order and Delivery Updates
If you would like to receive text messages about your orders and account info from Room & Board, you may opt in via web (https://www.roomandboard.com). Message frequency varies. Message and data rates may apply. Consent to receive text messages is not required as a condition of purchase.
Opting in to receive text messages about your orders and account information does not constitute, and is not treated as, an opt in to receive marketing text messages from Room & Board.
Marketing Messages
If you would like to receive marketing messages from Room & Board, you may do so by registering on the website (https://www.roomandboard.com) or in our stores. Message frequency varies. Message and data rates may apply.
Effect of Opting In
By opting in to Room & Board’s Messaging Service, you consent to receive mobile text updates using an automatic telephone dialing system. While you consent to receive messages sent using an automatic telephone dialing system, the foregoing shall not be interpreted to suggest or imply that any or all of Room & Board’s mobile messages are sent using an automatic telephone dialing system.

By opting in, you are confirming you are over the age of 16.
How to Opt Out
Order and Delivery Updates
Text STOP to 64496 to stop receiving order and delivery updates from Room & Board (you will receive a confirmation text).
Marketing Messages
Text STOP to 83904 to stop receiving marketing messages from Room & Board (you will receive a confirmation text).
You understand and agree that the foregoing options are the only reasonable methods of opting out of the Messaging Service. You acknowledge that the Messaging Service may not recognize and respond to unsubscribe requests that alter, change, or modify the STOP, keyword command, such as the use of different spellings or the addition of other words or phrases to the command, and agree that Room & Board and its service providers will have no liability for failing to honor such requests. You also understand and agree that any other method of opting out, including, but not limited to, texting words other than those set forth above or verbally requesting one of Room & Board’s employees to remove you from Room & Board’s list, is not a reasonable means of opting out.

Participation Requirements
To participate in the Messaging Service you must have a wireless device of your own, capable of two-way messaging, use a participating wireless carrier, and be a wireless service subscriber with text messaging service. Not all cellular phone providers carry the necessary service to participate; the supported carriers are listed below. Check your phone capabilities for specific text messaging instructions.

Prohibited Content
By opting into and using the Messaging Service you acknowledge and agree not to send any prohibited content using the Messaging System. Prohibited content includes but is not limited to:
- content that is false, misleading, unlawful, harmful, threatening, abusive, harassing, tortious, defamatory, vulgar, obscene, libelous, invasive of another’s privacy or content that could otherwise be considered to be objectionable.
Disclaimer of Warranty
The Messaging Service is provided on an "as-is" and “as available” basis and may not be available in all areas and at all times and may not continue to work in the event of product, software, coverage or other changes made by your wireless carrier. Room & Board is not liable for any delays or failures in your receipt of any mobile messages connected with the Messaging Service. Delivery of mobile messages is subject to effective transmission from your wireless service provider/network operator and is outside of Room & Board’s control. Carriers are not liable for delayed or undelivered mobile messages.
Indemnification
YOU AGREE TO INDEMNIFY, DEFEND, AND HOLD ROOM & BOARD HARMLESS FROM ANY CLAIM OR LIABILITY RESULTING FROM YOUR FAILURE TO NOTIFY ROOM & BOARD OF A CHANGE IN THE INFORMATION YOU HAVE PROVIDED, INCLUDING ANY CLAIM OR LIABILITY UNDER THE TELEPHONE CONSUMER PROTECTION ACT, 47 U.S.C. § 227, et seq., OR OTHER APPLICABLE STATE AND/OR FEDERAL LAW, AND ANY REGULATIONS PROMULGATED THEREUNDER RESULTING FROM ROOM & BOARD ATTEMPTING TO CONTACT YOU AT THE MOBILE TELEPHONE NUMBER YOU PROVIDED TO PARTICIPATE IN THE MESSAGING SERVICE.
Miscellaneous
You warrant and represent to Room & Board that you have all necessary rights, power, and authority to agree to these terms and perform your obligations hereunder, and nothing contained in these Mobile Terms & Conditions or in the performance of such obligations will place you in breach of any other contract or obligation. The failure of either party to exercise in any respect any right provided for herein will not be deemed a waiver of any further rights hereunder. If any provision of these Mobile Terms & Conditions is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that these Mobile Terms & Conditions will otherwise remain in full force and effect and enforceable. Any new features, changes, updates or improvements of the Messaging Service shall be subject to these Mobile Terms & Conditions unless explicitly stated otherwise in writing.
These Mobile Terms & Conditions are incorporated into our Terms of Use.
We take your privacy seriously. We will protect the privacy of information provided in accordance with our Privacy Policy. Please review our Privacy Policy.
If you do not agree with our Mobile Terms & Conditions, Terms of Use, and Privacy Policy please do not use our Messaging Service.
