Terms of Sale

These Terms of Sale govern all purchases, changes, and returns you make with Room & Board (“we,” “us,” or “our”). Please consult our Returns & Exchanges policy for information about when and how to return your purchase.

  1. Charges; Payment

    • You are responsible for paying the purchase price, shipping charges and any tax for your purchase as noted on Room and Board’s website’s (the “website”) shopping cart or final sales page. Payments may be made in the currencies and via the payment methods specified on the website’s shopping cart of final sales page.
    • Prices displayed on the website are exclusive of taxes. When you proceed to purchase your product(s), any sales, use or value added tax (where applicable) will be calculated on the total product(s) value when possible, along with any shipping charges.
    • If you elect to pay for your purchase by credit card you are responsible for providing a valid credit card number at checkout. You represent and warrant that you are an authorized user of the credit card number provided, and you agree to pay all charges resulting from your purchases of product(s), including any unauthorized charges incurred prior to your notice to us of such charges. You agree that we may pass your credit card information and personally identifiable information to our designated service provider(s) to process the credit card payment for your purchases. We will comply, and will ensure that our designated services provider(s) comply, with any credit card processing rules and privacy regulations.
    • By agreeing to these Terms of Sale you hereby affirmatively consent to Room & Board’s collection, use and storage of the credit card merchant tokens for a period of 120 days to process the initial payment and any refunds in accordance with our Returns & Exchanges policy.
    • If you make changes to an order that has not yet shipped, we will use your card on file. We will ask you to provide your consent to use this card. If you do not provide your consent, your changes will not be processed.
    • We do not accept card data by email, text, chat or on paper. If you send card data via an insecure channel, we will delete it and ask you to use our secure checkout.
  2. Billing Descriptor & Order Confirmation

    • Your card statement will show the charge from “Room & Board.”
    • Your order confirmation email will include: (i) your itemized order, (ii) a reminder of our billing descriptor, (iii) a link to these Terms of Sale and our Returns & Exchanges policy and (iv) tracking details when available.
  3. Fraud Screening & Identity Verification

    We use automated and manual fraud screening. We may request additional verification from time to time (for example, confirming order details or identity) before shipping. If verification is not completed within three business days, we will cancel the order.

  4. Shipping, Delivery & Risk of Loss

    • We ship to U.S. addresses only.
    • Your order is considered to have been “delivered” when the carrier confirms that delivery was made to the address provided at checkout.
    • Risk of loss passes to you upon delivery confirmation by the carrier.
    • We may, at our discretion, require an adult signature on delivery.
  5. Addresses & Undeliverable Shipments

    • You are responsible for providing an accurate shipping address and contact information.
    • Please make sure that the shipping address is correct, as we are unable to redirect orders once shipped. Please note that before we can ship your purchased product(s), we may need to confirm your security or other details with your credit card issuer. To avoid delays with your order, please ensure that your billing address matches the address on your card statement, and that the cardholder's name is entered as it appears on the card. Please also ensure that the contact details provided in your order or in your user account are accurate so that we can contact you if necessary.
    • If a shipment is returned as undeliverable, we will contact you to reship at your expense or issue a refund less shipping charges.
    • We reserve the right to decline shipping to an address that is different than the billing address on your payment card.
  6. Returns & Refunds

    • You agree that returns are governed by our Returns & Exchanges policy.
    • Refunds are issued only to the original payment method after we receive and inspect returned items in accordance with the Returns & Exchanges policy.
    • Risk of loss remains with you until we receive the returned items.
    • Returned items that we deem are damaged will not be refunded.
    • Once we issue a refund, your card issuer will process it. You should contact your card issuer with any questions.
  7. Cancellations

    Prior to shipment, you may request cancellation of the order by contacting us at 800.301.9720. If your order has already shipped, refer to the Returns & Exchanges policy for more information.

  8. Disclaimer of Warranties and Limitation of Liability

    EXCEPT AS NOTED IN THIS TERMS OF SALE, THE TERMS OF USE, OR THE RETURNS & EXCHANGES POLICY, ALL PRODUCTS AVAILABLE THROUGH THIS WEBSITE ARE PROVIDED ON AN "AS IS, WITH ALL DEFECTS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESSED OR IMPLIED, INCLUDING WITHOUT LIMITATION, WARRANTIES OF TITLE, NON-INFRINGEMENT OR IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. NOTHING IN THESE TERMS OR IN ANY DESCRIPTION OF PRODUCTS OR SERVICES SHALL CONSTITUTE A REPRESENTATION OR WARRANTY WITH RESPECT TO SUCH PRODUCTS OR SERVICES. FURTHER, WE MAKE NO REPRESENTATION OR WARRANTY THAT CONTENT PROVIDED ON THIS SITE IS APPLICABLE OR APPROPRIATE FOR USE IN LOCATIONS OUTSIDE OF THE UNITED STATES. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, WE ARE NOT RESPONSIBLE FOR TYPOGRAPHICAL ERRORS OR OMISSIONS RELATING TO PRICING, AVAILABILITY, TEXT OR PHOTOGRAPHY. WE MAKE NO REPRESENTATION OR WARRANTY THAT THE PRODUCTS OR SERVICES ADVERTISED OR OFFERED ON THIS WEBSITE WILL BE AVAILABLE AT ALL TIMES, OR THAT THEY WILL BE AVAILABLE ON THE BASIS OF ANY INDICATED TERMS OR CONDITIONS.

    TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, NEITHER ROOM & BOARD OR ITS AFFILIATES OR AGENTS SHALL BE LIABLE FOR ANY, INDIRECT, INCIDENTAL, SPECIAL OR CONSEQUENTIAL DAMAGES CAUSED BY YOUR USE OF THIS WEBSITE, MARKETING COMMUNICATIONS OR FOR PRODUCTS YOU PURCHASE THAT ARE NOT AS WARRANTED. THE LIMITATIONS OR EXCLUSIONS OF LIABILITY STATED HEREIN APPLY IN THE STATE OF NEW JERSEY, USA, TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW. HOWEVER, CERTAIN STATE LAWS DO NOT ALLOW LIMITATIONS ON IMPLIED WARRANTIES OR THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES, IN WHICH CASE, SOME OR ALL OF THE ABOVE DISCLAIMERS, EXCLUSIONS, OR LIMITATIONS MAY NOT APPLY TO YOU, AND YOU MIGHT HAVE ADDITIONAL RIGHTS.

    Any disputes related to this Terms of Sale and purchase or products, shall be resolved according to the arbitration provisions set forth in the Terms of Use.

    Additionally, you hereby consent to our use of your account information, order history, chat logs, emails, phone conversations, device and network information and carrier delivery records, and any other reasonable evidence to resolve payment disputes and prevent fraud.
